home directory restore with protected directories

I have moved to a new host and recreated my website from a home directory backup and everything is fine EXCEPT I am getting an error (500) trying to execute a script in a formerly protected directory (I removed protection but still have the problem). In the error log I get:
[Tue Sep 27 20:45:39 2016] [error] [client 1.2.3.233] File does not exist: /home8/demotest/public_html/spy/cronjobs/sys_cpanel, referer: https://xxx.xxx.com/~demotest/spy/cronjobs/sync_put.php
(I put the xxx) what is sys_cpanel? why do i need it? is this likely a server/cpanel configuration, or restore issue, or permission isssue? I changed all scripts and directories to 775. also deleted contents of .htaccess etc. but did not delete files
